Terms of Service

These Terms of Service (“Terms”) govern your use of ProtoClaw (“ProtoClaw”, “we”, “us”, “our”), a managed hosting service for OpenClaw.

Plain-English summary
This summary is helpful, but the full Terms below control.
  • You’re getting a dedicated hosted OpenClaw instance; you’re responsible for what you connect it to and how you use it.
  • OpenClaw can take real actions (email, calendar, messaging). You must keep your account secure and follow the acceptable use rules.
  • AI can be wrong. Don’t treat outputs as professional advice, and always review before acting.
  • We provide the service “as is” and limit our liability to the maximum allowed by law.

1) The service

ProtoClaw provides managed infrastructure, updates, and configuration to run an OpenClaw instance for you (“Service”). Your instance may connect to third party channels (e.g., WhatsApp, Telegram, Slack, Discord, iMessage) and third party model providers (e.g., Anthropic, OpenAI) depending on your settings.

2) OpenClaw software

“OpenClaw” is third-party software. ProtoClaw is a hosting provider and is not affiliated with the OpenClaw project unless explicitly stated. Your use of OpenClaw is also subject to OpenClaw’s own license terms and any third party terms that apply to integrations you enable.

3) Accounts, security, and credentials

  • Account security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • Connected services: If you connect messaging channels, email, calendars, storage, or other third-party services, you represent you have the rights and permissions to do so.
  • API keys: If you provide API keys (for models or integrations), you are responsible for associated costs and compliance with those providers’ terms.

4) Your content & data

You retain ownership of content you submit to the Service (“Customer Data”), including messages, files, configurations, skills you add, and outputs you generate. You grant ProtoClaw a limited license to host, process, transmit, and display Customer Data solely to operate, secure, and improve the Service and to provide support.

5) Acceptable use

You may not use the Service to:

  • Break the law or infringe others’ rights.
  • Attempt unauthorized access, disrupt systems, scan networks, or bypass security controls.
  • Send spam, harassment, or abusive content, or facilitate fraud, phishing, or social engineering.
  • Deploy malware, exfiltrate data without authorization, or instruct the agent to perform harmful actions.
  • Use the Service in a way that could materially harm OpenClaw, ProtoClaw, or third parties (including by overloading the Service).

6) Fees & billing

Subscription fees (if any) are shown at checkout or on our website. Unless required by law, fees are non-refundable and billed in advance for each billing period. You are responsible for taxes, and for any third-party fees you incur (e.g., AI model usage, messaging providers, domain/DNS, etc.).

7) Support & access

We aim to keep your instance isolated and private. If you request support or if it’s necessary to maintain security, reliability, or comply with law, we may access limited service metadata and, when required, portions of Customer Data. We restrict internal access and use it only when needed.

8) Changes

We may update the Service and these Terms. If a change materially reduces your rights, we’ll take reasonable steps to notify you (for example, by email or in-product notice). Your continued use after changes become effective means you accept the updated Terms.

9) Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the security and integrity of the Service. Upon termination, your right to use the Service ends. Data deletion/export options may be available depending on your plan and technical constraints.

10) Disclaimers

  • No professional advice: Outputs may be inaccurate. ProtoClaw/OpenClaw do not provide legal, medical, financial, or other professional advice.
  • As-is: The Service is provided “as is” and “as available”, without warranties of any kind (to the maximum extent permitted by law).
  • Third parties: We do not control and are not responsible for third-party platforms, integrations, or model providers.

11) Limitation of liability

To the maximum extent permitted by law, ProtoClaw will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, ProtoClaw’s total liability for all claims is limited to the amounts you paid ProtoClaw for the Service in the 3 months before the event giving rise to the claim.

12) Indemnity

You agree to indemnify and hold harmless ProtoClaw from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
